Registration & passwords

To access certain features, including client portals, you may be required to register and create an account. You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. If you suspect unauthorized use of your account, notify us immediately via our contact page.

Borrower data & service-provider role

Customers may provide information about their own borrowers or clients (“Customer Data”) in order to receive the services. Monster Metrics, LLC processes Customer Data solely as a service provider acting on the customer’s behalf, to provide the contracted monitoring and outreach services. We do not sell Customer Data; we do not share it with nonaffiliated third parties except vendors necessary to deliver the services under confidentiality obligations; and we do not use it to market any product or service other than the customer’s own.

Prohibited data. Customers must not submit Social Security numbers, dates of birth, credit reports or scores, income or employment records, bank or financial account numbers, or loan files, applications, or supporting documents. The services provide no fields for such data, and any inadvertent submission will be deleted upon discovery.

Retention. Upon termination of an account, Customer Data is deleted upon written request, and in any event within 30 days.

Customer representations

By providing Customer Data to the services, you represent and warrant that: (a) you are authorized to provide it — including, where the borrower relationship is owned by your employer or another institution, that you have that institution’s authorization; (b) the data was collected, and may be used for the contracted purposes, in compliance with applicable law, including the Gramm-Leach-Bliley Act and its implementing regulations; and (c) all outreach performed through the services will comply with applicable communications laws, including the Telephone Consumer Protection Act and applicable do-not-call rules, and you hold and will maintain any consents that outreach requires.

You are responsible for obtaining and maintaining the authorizations and consents described above. We may suspend services that we reasonably believe are being used in violation of this section.

Termination

We reserve the right to terminate or suspend your access to the Site, without notice, if we determine that you have violated these Terms of Service or engaged in conduct that we deem inappropriate or unlawful. Upon termination, you must cease all use of the Site and any content obtained from it.

Governing law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas. Any dispute arising under these Terms shall be resolved exclusively through binding arbitration in Austin, Texas.

Changes to Terms of Service

We may update these Terms of Service from time to time. The latest version will always be available on this website with its effective date.
